HOW TO CLAIM

To be eligible to receive a cash back consumers must:

1.Simply purchase one packet of Nicabate Minis 60 lozenges to receive a $10 cash back OR purchase two packets of Nicabate Minis 20 lozenges to receive a $5 cash back from a pharmacy between 01/05/09 and 31/08/09 (promotional period).

2. Complete details in the downloadable entry form, attach original pharmacy receipt(s) and Nicabate Minis product barcode(s)

3. Send “Reply Paid” to: ‘Reply Paid’ Nicabate Minis Cash Back, Locked Bag 7000, Neutral Bay, NSW 2089.

TERMS AND CONDITIONS:

1. Information on how to claim the Nicabate Minis Cash Back offer forms part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions. Offer not valid in conjunction with any other offer.
2. Entry is only open to Australian residents who are 18 years and over who purchase a Nicabate Minis product during the promotional period. Employees (and their immediate families) of the Promoter, participating outlets and their agencies associated with this promotion are not eligible to enter.
3. Promoter reserves the right to verify the validity of claims including contacting pharmacies and claimants (including a claimant’s identity, age and place of residence) and to disqualify any claimant for tampering with the claim process or for submitting a claim that is not accordance with these Terms and Conditions.
4. The promotion is available only at participating pharmacies.
5. The maximum cash back per claimant is $10.
6. To be eligible, consumers must purchase two packets of Nicabate Minis 20 lozenges to receive the $5 cash back OR one packet of Nicabate Minis 60 lozenges to receive the $10 cash back from a participating pharmacy, complete the back of the entry leaflet, attach original pharmacy receipt(s) and Nicabate Minis barcode(s) and send ‘Reply Paid’ to ‘Reply Paid’ Nicabate Minis Cash Back, Locked Bag 7000, Neutral Bay, NSW 2089.
7. Promotion commences 9am AEST 01/05/09 and concludes 5pm AEST 31/08/09. All claims must be received by last mail on 01/09/09. Promoter’s decision is final and no correspondence will be entered into.
8. A photocopy of the claimant’s pharmacy receipt(s) and a copy of their barcode(s) must be kept as proof of purchase. Failure to provide proof of purchase at the Promoter’s request may in the absolute discretion of the Promoter result in invalidation of the entry and forfeiture of the right to receive a cash back.
9. Claimants will receive a cheque in Australian dollars. Claims will be honoured at the discretion of the Promoter.
10. The $5 and $10 cash back will be paid to the claimant named on the back of entry form. Cheques will be sent out to the winner within 28 days from the date of receipt of entry.
11. Nicabate Minis must be purchased from a participating pharmacy. Claims will not be accepted on any product other than the specific Nicabate Mini products. Claims will not be accepted if made on prescription or any other government social benefit.
12. The cash back cheques cannot be transferred to another person or organisation.
13. All claim forms, and the attached proof or purchases, become property of the promoter.
14. The Promoter may need to collect personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. All personal information will be stored at the office of the Promoter. A copy of the Promoter’s Privacy Policy in relation to the treatment of personal information collected may be obtained by accessing the Nicabate website www.nicabate.com.au.
15. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves
    the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any claimant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
16. Any cost associated with accessing www.nicabate.com.au to download the entry form is the claimant’s responsibility and is dependent on the Internet service provider used.
17. No responsibility will be taken for cheques once they have been posted.
18. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following:
    (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any claim or offer that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in offer value to that  stated in these Terms and Conditions; or (e) any tax liability incurred by a claimant.
