TERMS AND CONDITIONS
1. Information on how to enter and Prize details form part of these terms and conditions. If there is any conflict between these terms and conditions and any other published material, these terms and conditions are to prevail. Entry into the competition constitutes acceptance of these terms and conditions.
2. Entry is open to Australian residents over the age of 18 who are pharmacy assistants (“eligible entrants”). Employees of the Promoter (and their immediate families) and its agencies associated with this promotion, are not eligible to enter.
3. The promotion commences at 12.01am (ADST) on 18 January 2010 and closes at 5.00pm (ADST) on 26 March 2010 (“Promotional Period”).
4. Eligible entrants must either, enter via the promotion mailer, complete the entry form including the answers to the three (3) questions and fax to (02) 9953 9901, OR SMS the answers to the 3 questions, with their first and last name to 0408 555 886 (The SMS service provider is AI.COM.AU Pty Ltd. The cost of the SMS is a maxium $0.55 including GST and will not exceed that amount. Entry by SMS must be sent via an Australian mobile telephone carrier).
There is a limit of one entry per person (via fax or phone).
5. The draw will take place at 2.00pm (ADST) on 30 March 2010 at 15 Grosvenor Street, Neutral Bay NSW 2089. The winners will be notified by phone, in writing, and will have their names published in The Australian newspaper on 9 April 2010.
6. There will be one draw and 3 prize winners. The first 3 eligible entries drawn as the winners will each receive a Nintendo Wii & Balance Board valued at $558 each ("the Prize"). Total prize pool value is $1,674.
7. The judges’ decision is final and no correspondence will be entered into. The Prizes are not exchangeable, transferable or redeemable for cash. Prizes will be despatched to the winners via registered post once winners have confirmed their acceptance of the prize.
8. Tax implications may arise from the Prize winnings. Independent advice should be sought.
9. The Promoter reserves the right to redraw in the event of a winner being unable to satisfy these terms and conditions or forfeiting or not claiming a Prize. For any Prize that remains unclaimed or is forfeited through ineligibility or otherwise the Promoter will conduct a further draw at the same time and place as the original draw on 16 July 2010 subject to any applicable law. Any winner will be notified by phone, in writing, and their name will be published in The Australian newspaper on 23 July 2010.
10. Entry details will be used solely for the purposes of this competition and will then be destroyed by The Promoter.
11. The Promoter is not responsible for any incorrect or inaccurate information or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including (but not limited to) any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
12. The Promoter is not liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or a consequential loss), or for personal injury suffered or sustained as a result of taking any prize, except for any liability that cannot be excluded by law.
13. The Promoter reserves the right (subject to any applicable law) to vary the rules of any competition or any prizes offered or cancel any competition if it is no longer able to run the competition due to reasons beyond its control. The Promoter will not be liable for any loss or damage to any party arising from any variation or cancellation.
